By downloading, installing, or using Privata ("the App"), you agree to these terms. If you do not agree, do not use the App.

Privata is a peer-to-peer encrypted messaging application built on the open-source Bitchat protocol. It provides:

Privata is provided as a decentralized communication tool. There is no central service, no user accounts, and no server infrastructure operated by the developer.

Privata is proprietary software. All rights are reserved. The underlying Bitchat protocol is open-source and licensed separately.

THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT. IN NO EVENT SHALL THE AUTHORS BE LIABLE FOR ANY CLAIM, DAMAGES OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT OR OTHERWISE, ARISING FROM, OUT OF OR IN CONNECTION WITH THE SOFTWARE OR THE USE OR PERFORMANCE OF THIS SOFTWARE.

6. Cryptographic Identity

Your identity in Privata is a cryptographic keypair stored on your device. You are solely responsible for your device security. If you lose your device or delete the app, your identity and message history cannot be recovered — by you or by anyone else.

7. Third-Party Networks

Privata interacts with decentralized third-party networks (Nostr relays, Tor network, Blossom servers, and the Bitchat mesh) that are not operated or controlled by the developer. The developer is not responsible for the availability, performance, or policies of these networks.

8. Beta Software

Privata is currently in beta. The software may contain bugs, experience data loss, or behave unexpectedly. By participating in the beta, you acknowledge these risks and agree that the developer is not liable for any data loss or other issues arising from beta usage.

9. Limitation of Liability

To the maximum extent permitted by law, the developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the App.

10. Changes to These Terms

These terms may be updated from time to time. Changes will be posted on this page with an updated revision date. Continued use of the App after changes constitutes acceptance of the updated terms.
